Competition Dispute & Resolution

The SHA Competition Dispute Resolution Process will deal with complaints and disputes which are considered by the complainant to contravene any of the 10 principles and rules of cooperation and competition (PRCC) and/or Code of Practice for the Promotion of NHS-funded services (see NHS_Promotion_Code) have already exhausted PCT processes. Any complaints or disputes must be referred to the PCT concerned in the first instance. For contact details for all West Midlands NHS organisations including PCTs click here.

The West Midlands SHA approved the Competition Disputes Resolution Policy (CDRP) at its Public Board Meeting on the 25th November and passed Equality Impact assessment Screening in December 2008.

Complaints

The SHA will normally only consider complaints that have been through the appropriate PCT's Competition Dispute Resolution Process, or those that have been escalated to the SHA by the PCT itself. The SHA has developed its Competition Dispute Resolution Process, which can be accessed via here. Any complaint to the SHA should be made via: here.

Note: The SHA offers a mediation service which is designed to allow the complainant the opportunity to resolve the complaint informally.
